Property litigation and dispute resolution
We’ll help you to manage the dispute so that you can remain focused on running your business… and your life.
We represent owners and tenants of large swathes of both rural and urban Scotland. All aspects of land-based disputes, including agricultural disputes, are familiar to the property litigation group led by John Stirling.
Our group works with our commercial and residential property teams to reinforce advice on dispute and arbitration clauses in commercial contracts.
We deal with residential, commercial and industrial property issues, including:
- Boundary disputes
- Rectification of Land Certificates
- Rent reviews
- Dilapidation claims
- Rating appeals
- Planning
- Nuisance
- Pollution
- Regulatory compliance generally
- Agricultural tenancies
- Crofting
In addition, we handle debt collection, trade and contract disputes, insolvency, personal injury claims, road traffic law, human rights issues and judicial review. We frequently advise on cross-border litigation and international arbitration.
We recently acted for a client in a case where a Land Certificate has been issued in error which gives a right of access to a development site to the wrong party, another where rights of access to land are challenged and a third where an agricultural tenancy under the Agricultural Holdings (Scotland) Act 1991 is claimed. Property litigation is a wide field.
The firm acts for over one million acres of Scotland. Land holdings of that size generate a vast variety of disputes; we deal with them all.
