Letting Agent Code of Practice

On 31 January 2018 the new Letting Agents Code of Practice took effect. 

The code is authorised under section 46 of the Housing (Scotland) Act 2014, and sets out various standards which letting agents must comply with. One of the associated issues is that a register of letting agents is to be set up, and there will be a “fit and proper person” test before someone is allowed to register as a letting agent. Agents must make an application to register before 1 October 2018.

The code governs such things as the handling of landlord’s and tenant’s money, procedure at letting, routine inspections, dealing with repairs and maintenance, as well as setting out “overarching standards of practice”.  You can find a copy of the full code here.
