Tenanted Farms - Maintenance and Repairs

Scotland’s Tenant Farming Commissioner, Dr Bob McIntosh issued his fourth “guidance note” at the end of January. 

The topic addressed being the parties respective obligations regarding maintenance and repairs to the holding while a lease is ongoing.  The code makes various recommendations, as well as setting out what the parties should, and must do.  The overall approach is that parties should collaborate and agree what work needs done, who will do it, and when it will be done by.

Whilst setting out a code of practice and encouraging dialogue may be helpful, the underlying problem in many cases is lack of available funds, rather than lack of willingness to engage in a discussion. You can find the code here.
