On 19 September 2025, the Scottish Government published a consultation on reforming compulsory purchase in Scotland. Almost all of the legislation governing compulsory purchase procedures is over 50 years old, with some approaching 200 years old. The consultation states “The proposals set out here could provide the basis for a more effective and modernised system which is less onerous for authorities – and fairer and more transparent for those affected.” The main focus of the proposals is on reform of the process to grant a compulsory purchase order, although there are some proposals that deal with compensation payable to those affected. The relatively new concept of “compulsory sales orders”, and a brand new concept of “compulsory lease orders”, are also being consulted upon.
There is considerable detail in the lengthy consultation, which closes on 19 December 2025, with the outcome of the consultation important for both promoters of orders and those potentially affected. We will review the detail as well as monitor progress of the consultation to consider and communicate the potential implications for our clients.
